AND DISCLOSURE OF YOUR NAME, TELEPHONE NUMBER, EMAIL, AND HOME ADDRESS

ENKI MAY BE REQUIRED TO DISCLOSE YOUR NAME, HOME ADDRESS, PERSONAL TELEPHONE NUMBER AND PERSONAL E-MAIL ADDRESS UNLESS YOU ACT TO OBJECT TO THIS DISCLOSURE AS SET FORTH BELOW.

A former employee of Enki, Athena Merianos ("Merianos"), has filed a lawsuit against ENKI. The lawsuit, Athena Merianos v. ENKI Health & Research Systems Case No. 20STCV22369, is now pending in the Los Angeles County Superior Court. In the lawsuit, Merianos alleges claims that ENKI failed to comply with several California wage and hour laws. ENKI has filed an Answer in the lawsuit denying all of the allegations in their entirety and maintains that it has complied with all applicable laws. The lawsuit is currently in a phase known as pre-trial discovery. No trial date on the lawsuit has been set by the Court and the Court has made no decisions whatsoever on the merits of Ms. Merianos' claims.

The lawyers who filed the lawsuit on behalf of Ms. Merianos have requested that Enki disclose your personal contact information including your name, home address, personal phone number, and personal e-mail address, for the purpose of allowing them to contact you about Merianos' lawsuit and your employment at ENKI. Enki has objected to this disclosure on your behalf on the grounds of your privacy rights and, as a result, no disclosure of your personal information has yet been made. However, under the law, the final decision on whether to disclose this personal information is yours to make which is why this Notice is being sent to you.    

The purpose of this Notice is to allow you to decide whether or not you want your name and personal contact information to be disclosed. You have the right to request that such information be withheld from Merianos' attorneys on the grounds of privacy. You also have the right not to speak to the lawyers for Ms. Merianos.

THE FORM IS BEING SENT BY REGULAR MAIL, AND IS TO BE RETURNED TO, A NEUTRAL ADMINISTRATOR, WHO IS NOT AFFILIATED WITH EITHER MERIANOS OR ENKI, TO ENSURE THAT YOUR PERSONAL INFORMATION IS PROTECTED. IF YOU OBJECT TO DISCLOSURE NEITHER YOUR NAME NOR E-MAIL ADDRESS, WHICH THE ADMINISTRATOR HAS ONLY USED TO CONTACT YOU, WILL BE DISCLOSED BY THE ADMINISTRATOR. YOU MAY RECEIVE THIS NOTICE MORE THAN ONCE BUT YOU ONLY NEED TO RETURN THE FORM ONE TIME. If you choose not to consent to disclosure of your personal information, or choose not to speak to the attorneys for Ms Merianos, there will be no adverse consequences to you or your employment at Enki whatsoever. Further, any potential rights or claims you may have related to your employment at Enki, whether or not related to the lawsuit brought by Ms. Merianos, will not be affected. It is against the law for anyone to retaliate against you in any way for speaking (or not speaking) with the lawyers for Ms. Merianos' or ENKI about this case, or for supporting or opposing the lawsuit.
